1Agreement to Terms

By accessing, browsing, creating an account, or using Create3DOnline ("Create3DOnline", "we", "us", or "the Service"), you confirm that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree, you must discontinue use immediately.

2Eligibility & Age Requirement (Strict 18+)

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use Create3DOnline. By using the Service, you represent and warrant that you meet this age requirement.

3User Content, Ownership & Limited License

You retain 100% ownership of all images, concept art, prompts, and visual references you submit to the Service ("User Content").

By submitting User Content to Create3DOnline, you grant us a worldwide, non-exclusive, royalty-free, limited license solely to reproduce, store, process, and transmit your User Content as necessary to perform the requested 3D mesh reconstruction, multi-object segmentation, and format conversion operations.

4AI-Generated Outputs & Disclaimers

Because generative artificial intelligence models operate on probabilistic algorithms:

• Nature of Outputs: We do not guarantee that generated 3D meshes will meet specific artistic expectations, remain artifact-free, or be identical across repeated submissions. Always inspect meshes before production deployment.
• Commercial Use: Subject to your compliance with these Terms, Create3DOnline assigns to you whatever rights, title, and interest we may hold in the generated 3D outputs (GLB, OBJ, USDZ, STL). You are responsible for ensuring that your commercial use of outputs complies with applicable local laws and regulations.

5Acceptable Use & Prohibited Content

You agree never to upload, generate, distribute, or facilitate content that involves:

Create3DOnline complies with the United States Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe your copyrighted material is being processed or distributed without authorization, please consult our dedicated DMCA Notice & Takedown Policy or send a takedown notice to copyright@create3donline.com.

7Credits, Pricing & Billing

Create3DOnline uses a credit-based model for AI 3D reconstruction tasks. Generation runs deduct credits based on the chosen workflow (e.g. 30 credits per generated 3D object).

• Payments are processed securely by our authorized checkout partners (Whop and Freemius). Applicable VAT and sales taxes are collected at checkout.
• Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to renewal in your dashboard settings.

8Refunds & EU Consumer Rights

Please review our full Refund Policy. Key principles include:

• Failed Generations: If a 3D generation job fails due to an API timeout or platform error, credits are automatically restored to your account.
• EU Right of Withdrawal Waiver: For digital content/services, you expressly consent to immediate commencement of performance and acknowledge that you lose the 14-day statutory right of withdrawal once processing begins.

9Disclaimers & Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CREATE3DONLINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO CREATE3DONLINE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These Terms shall be governed by and construed under the laws of the State of Delaware, United States, without regard to its conflict of law principles.
